• Contest is sponsored by Black Diamond Broadcasting / Rock 105 (“Station”). OK
• Prize supplied by Burt Lake Marina (“Supplier”). Ok

1. Eligibility

• Contest open to U.S. residents, 18 years of age or older, with valid driver’s license.
• Employees of Station, Supplier, affiliated advertising/PR agencies, immediate family members, and household members are not eligible.

2. Contest Period & How to Enter

• Contest begins [9/2] and ends [10/30].
• Entry methods may include on-air, online, live events/remotes, or other promotions announced by the Station.
• No purchase necessary. Void where prohibited.

3. Prize

• One (1) 2023 Can-Am Maverick Turbo 4-Seater Side-by-Side (SxS). Brand New
• Approximate Retail Value (ARV): $[$29,773].
• Prize provided “as is” by Supplier. Station is not responsible for any warranty, maintenance, or future costs associated with ownership.
• Prize is non-transferable, non-exchangeable, and may not be substituted for cash.

4. Winner Responsibilities

• Winner must provide valid driver’s license and proof of insurance at time of prize acceptance.
• Winner is responsible for all taxes (federal, state, local), title, registration, licensing fees, and any other costs associated with claiming, accepting, or operating the prize.
• Winner may name a Proxy, to attend and accept the grand prize drawing event on 11/1 at Burt Lake Marina in Indian River, MI.
• Winner/Proxy agrees to sign all necessary IRS forms (including Form 1099) prior to delivery.
• Winner must take delivery of prize at Burt Lake Marina within [30] days of notification, or prize will be forfeited.

5. Station Responsibilities

• Station will conduct contesting and determine winner in accordance with these rules.
• Station’s decisions regarding all aspects of the contest are final and binding.
• The Station will facilitate and coordinate the drawing event.
• Station is not responsible for prize delivery delays or issues outside its control.

6. Supplier Responsibilities (Burt Lake Marina)

• Supplier agrees to provide the prize as described and in new, unused condition.
• The Supplier will host the Grand Prize Drawing Finale.
• Supplier will transfer ownership/title directly to the winner upon prize acceptance.
• Supplier is not responsible for taxes, fees, or other winner obligations.
• Supplier may require winner to sign release forms at time of being announced the winner of the prize.
• The Supplier will work directly with the winner to arrange prize delivery, provided delivery is within a 100-mile radius of the dealership. If delivery is not available within that area, the winner is responsible for arranging pickup.

7. Release & Publicity

• By entering, participants agree to release and hold harmless Station, Supplier, their affiliates, and their employees from any liability arising from participation or prize use.
• Winner grants Station and Supplier the right to use their name, likeness, and voice for promotional purposes without additional compensation.

8. General Conditions

• Station reserves the right to modify or terminate the contest due to fraud, technical issues, or unforeseen circumstances.
• Station reserves the right to disqualify any participant who violates rules or tampers with the contest.
• Copies of official rules are available at WWW.ROCK105.FM  and at the Station studios during business hours.

This framework clearly splits who does what:

• Station: ROCK 105.1 WGFM runs the contest, selects winner, coordinates.
• Supplier: Burt Lake Marina provides the Can-Am, handles delivery/title.
• Winner: pays taxes, fees, insurance, registration, and signs release.

General Contest Rules:

 1. Black Diamond Broadcasting contests require no purchase or payment necessary to enter or to win. All U.S., Federal, State, Local and Municipal laws and regulations apply. Void where prohibited.

2. Contest winners are limited to one winner per household every 30 days. For prize values over $500, a limit of one winner per household every 180 days.

3. ELIGIBILITY: Employees of Black Diamond Broadcasting, its affiliates, other radio stations, media outlets, promotional sponsors, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win prizes. The term immediate families include spouses, grandparents, siblings, children, and grandchildren.

4. ODDS: The odds of winning a prize depend on the number of people attempting to participate in the contest at any given time.

5. WINNER NOTIFICATION AND ACCEPTANCE: The Winner may waive his or her right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Black Diamond Broadcasting reserves the right to substitute prizes of equal or greater value. The Winner is solely responsible for the reporting and payment of any taxes on prizes. As a condition of receiving the contest prize, the Winner will be required to complete an affidavit of eligibility and a liability, and publicity release, which must be signed at the time the winner claims his/her prize at the Black Diamond Broadcasting. Failure of to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Black Diamond Broadcasting, result in winner's disqualification, the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes the Winner's consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from Black Diamond Broadcasting, and on the Black Diamond Broadcasting Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation.

6. PARTICIPATION: Players/Winners must live in Michigan, within the Black Diamond Broadcasting radio group, geographic signal reach. (streaming our station music, is not a guarantee of contest eligibility) Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. Black Diamond Broadcasting reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest.

7. LIMITATIONS OF LIABILITY: By entering the Contest, contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

8. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and Black Diamond Broadcasting in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Michigan, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Michigan. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

9. GENERAL RELEASE: By entering the Contest, contestants release Black Diamond Broadcasting any other promotional sponsors, and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

10. Contests are sponsored by Black Diamond Broadcasting, PO BOX 6016, Traverse City, Mi, 49696 whose decisions regarding the selection of winners and all other aspects of Contest shall be final and binding in all respects. Black Diamond Broadcasting will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials.

 11.  Some Contests may include an addendum to the rules or have age requirements, such as age 21+ due to nature of the prize award or request of the contest sponsor.
